§ 1 Subject of the Regulation TKÜV

This regulation governs

1. … the basic requirements for the design of the technical facilities necessary for the implementation of the … telecommunications surveillance measures envisaged, as well as organizational benchmarks for the implementation of such measures by means of these facilities,

5. … in which telecommunication systems, permanently or temporarily, no technical facilities for the implementation of arrangements for the surveillance of telecommunications or no organizational arrangements must be made,

7. the requirements for the recording terminals to which the recording and evaluation equipment is connected, and

8. the requirements for the transmission procedure and the data format for requests for information on traffic data and the associated results

§ 3 Circle of Obligations

(1) The requirements of this part apply to telecommunication operators providing publicly available telecommunications services. ….

(2) No provision shall be made for telecommunications equipment as referred to in paragraph 1, to the extent that

5. they are not connected to more than 10 000 subscribers or other end-users .

Sentence 1 Number … 5 shall not apply to network nodes which serve to arrange a publicly available telephone service abroad.*

Anyone who provides telecommunications services for other and operates a telecommunications system connected to foreign networks is required to make his telecommunications system capable of being monitored from the first subscriber. **
