With the government bill on IP address retention and the further development of investigative powers in criminal proceedings (Bundestag printed paper 21\/6581), Germany is introducing a <strong>Sicherungsanordnung<\/strong>: an order that obliges telecommunications providers to preserve existing traffic data immediately, before a court decides whether the data may be disclosed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For providers, this means a new, time-critical process: receive the order, freeze the data, store it separately and securely, watch the deadlines, disclose it only on a second order, and delete it irreversibly. This article explains what the draft requires, who is affected and how to prepare.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Status: This article reflects the government draft as introduced in the Bundestag (first reading on 24 June 2026, now in committee). Instead of storing everyone&#8217;s traffic data in advance, authorities can order a provider to <strong>&#8220;freeze&#8221; data that already exists<\/strong> about specific persons or locations, as soon as there is a concrete reason. Maximum three months, with a court-ordered extension of up to three more months on application of the prosecutor.<\/li>\n\n\n<li><strong>\u00a7 25a BPolG-E<\/strong> (Federal Police, threat prevention): written order by the President of the Federal Police Headquarters or the head of a directorate, maximum three months, extendable by a court by up to three months at a time.<\/li>\n\n\n<li><strong>BKAG<\/strong>: corresponding powers for the Federal Criminal Police Office.<\/li>\n\n\n<li><strong>Federal states<\/strong>: the Bundesrat has asked for preservation powers for state police as well. This is still open in the committee.<\/li>\n\n\n<li><strong>\u00a7 176 TKG-E<\/strong> gives providers the authority to process the data. It addresses anyone who &#8220;provides publicly available telecommunications services <strong>or participates in providing them<\/strong>&#8220;, so service providers acting on a provider&#8217;s behalf are covered directly.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"which-data-is-covered\">Which Data Is Covered?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>In scope (traffic data under \u00a7 3 No. 70 TKG):<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Connection data: calling and called numbers, IMSI, IMEI, timestamps, duration, service type (voice, SMS, data)<\/li>\n\n\n<li>Location data, including cell IDs. An order can also cover entire radio cells if it describes them narrowly in space and time.<\/li>\n\n\n<li>Internet session data: assigned IP address, ports, start and end, volume<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Out of scope:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Content of communications (message text, call content)<\/li>\n\n\n<li>Data from the new IP address retention under \u00a7 177 TKG-E<\/li>\n\n\n<li>Usage data of digital services (covered by a separate provision)<\/li>\n\n\n<li>Subscriber data, which is requested through regular information requests, not frozen<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The freeze covers data that <strong>exists at the time of the order<\/strong> and, in the prevailing reading, data that <strong>arises until the deadline<\/strong>. Providers do not have to create data that their systems do not generate. Whether a freeze really extends to future data is still debated, but the wording (&#8220;to preserve without delay&#8221;) suggests freezing the existing data and continuing to add new data until the deadline.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"provider-obligations-step-by-step\">Provider Obligations Step by Step<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"1-receive-the-order-and-check-it-formally\">1. Receive the Order and Check It Formally<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Accept the order in writing. Electronic channels (ETSI-ESB \/ E-Mail-ESB) are expected in the TR TK\u00dcV, with details still open.<\/li>\n\n\n<li>Check the formal requirements: authorised authority, legal basis, identifier or cell description, data types, period, end date, duration of no more than three months.<\/li>\n\n\n<li>There is <strong>no substantive legality review<\/strong>. That responsibility lies with the authority.<\/li>\n\n\n<li>Ask the authority if identifiers or cell descriptions are unclear.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"2-freeze-the-data\">2. Freeze the Data<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Without delay and completely<\/strong>, extract the relevant records from mediation and CDR systems, HLR\/HSS logs, packet gateway (PGW\/UPF) session logs, RADIUS\/Diameter accounting and location logs.<\/li>\n\n\n<li><strong>Suspend the routine deletion<\/strong> of these records, which normally happens after a few days or weeks.<\/li>\n\n\n<li>Store them <strong>separately<\/strong> from all other subscriber data on a secured and reliable system.<\/li>\n\n\n<li>Apply <strong>state-of-the-art technical and organisational measures<\/strong>: encryption, access control, four-eyes principle and logging.<\/li>\n\n\n<li>Keep the data ready for <strong>immediate transmission<\/strong>.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"3-manage-the-freeze\">3. Manage the Freeze<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Monitor the <strong>deadline<\/strong> and wait for any court extension. Without an extension, the data is deleted when the order expires.<\/li>\n\n\n<li>Keep the order <strong>confidential<\/strong>. Informing the subscriber or third parties is an administrative offence.<\/li>\n\n\n<li><strong>Log<\/strong> all access under \u00a7 35 TK\u00dcV, which will also cover the new legal bases on which data is stored.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"4-disclose-only-on-a-separate-request\">4. Disclose Only on a Separate Request<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Disclosure is <strong>not automatic<\/strong>. It requires a separate request, typically a court order under \u00a7 100g (1) to (4) StPO or \u00a7 25 BPolG. The usual rules then apply: formal check by qualified staff or automatically, secured transmission, and the <strong>ETSI-ESB obligation for providers with 100,000 or more contract partners<\/strong>. For European orders, disclosure follows a European Production Order.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"5-delete-irreversibly\">5. Delete Irreversibly<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Delete the data <strong>without delay and irreversibly<\/strong> after transmission, or when the order expires.<\/li>\n\n\n<li><strong>Document the deletion<\/strong>. Failure to delete is subject to fines.<\/li>\n\n\n<li>For European preservation orders: delete once preservation is no longer required under Regulation (EU) 2023\/1543.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"6-inform-the-regulator-and-meet-the-deadlines\">6. Inform the Regulator and Meet the Deadlines<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Once the service starts, inform the <strong>BNetzA<\/strong> how the requirements are implemented, and report any changes without delay.<\/li>\n\n\n<li>On request, tell the BNetzA <strong>who stores the frozen data<\/strong>. This is where an external service provider is named.<\/li>\n\n\n<li>The BNetzA plans regular checks.<\/li>\n\n\n<li><strong>Timeline<\/strong>: the obligation applies once the law enters into force. The explanatory memorandum expects only about <strong>600 to 1,100 national orders per year<\/strong>. For most providers, readiness matters more than volume.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"practical-challenges\">Practical Challenges<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>&#8220;Without delay&#8221; means 24\/7 readiness.<\/strong> Automating extraction and freezing is the only realistic way to comply.<\/li>\n\n\n<li><strong>MVNOs depend on their host network.<\/strong> Cell, location and data session logs usually sit with the host MNO. Without a contractual data supply, an MVNO cannot comply with cell-based orders, so this must be clarified in the wholesale agreement. Designing to today&#8217;s BNetzA and BSI standards avoids costly rework later.<\/li>\n\n\n<li><strong>Data protection<\/strong>: an external service provider needs a data processing agreement (Art. 28 GDPR), and its staff must be bound by telecommunications secrecy.<\/li>\n\n\n<li><strong>Parallel e-Evidence orders<\/strong>: European Preservation Orders under Article 6 of Regulation (EU) 2023\/1543 must be handled with the same rigour.
