Como os fornecedores de telecomunicações se devem preparar para as ordens de prova eletrónica da UE

As operadoras de telecomunicações estão entre os prestadores de serviços mais afetados pelo Regulamento da UE sobre Provas Eletrónicas. A detenção de dados dos assinantes, access logs, CDRs and network metadata for millions of users, telcos will be primary recipients of European Production Orders, issued or validated by judges and prosecutors in the other Member States bound by the Regulation (every EU country except Denmark). The Regulation only reaches data an operator actually holds when the order arrives. It creates no retention obligation, so what can be produced depends on national retention law and your own billing and log retention. Since 18 August 2026, every operator that offers services in more than one Member State, or that is established outside the EU, must have a designated establishment or legal representative, notified to the national central authority (in Germany the Bundesamt für Justiz). New entrants have six months from launch. Operators established and active in only one Member State are exempt from the designation duty (Directive (EU) 2023/1544, Art. 1(5)).

Desafios específicos das empresas de telecomunicações

Unlike SaaS platforms or cloud providers that typically hold application-level data, telecommunications operators manage complex network infrastructure where relevant data is distributed across multiple systems: subscriber databases, HLR/HSS, RADIUS servers, CDR repositories, IP management systems, voicemail platforms and more. Mapping EPOC data category requests to these diverse sources requires deep network knowledge and automated extraction capabilities. Typical mapping: subscriber data from CRM/billing and HLR/HSS subscription records; data requested solely to identify a user (IP address, source port and timestamp) from RADIUS and CGNAT logs; traffic data from CDRs, session and location records; content from voicemail and stored messages.

O seu plataforma de mediação already delivers intercepted data over secured, audited handover links; for stored data, e-Evidence adds extraction from CRM, billing, CDR and log systems. Your LI security model (segregated systems, vetted staff, audited order handling) carries over. e-Evidence adds a new channel: the national e-Evidence system of the Member State where your addressee sits, reached through an API based on ETSI TS 104 144 or a web interface. Where the issuing authority supplies a certificate, results are encrypted to it. As of September 2026 only Germany and Ireland could receive orders this way; elsewhere orders arrive by other secure means. ICS builds on this existing investment to cover e-Evidence, adding the specific workflow, validation and reporting capabilities required by the Regulation, including the 10-day and 8-hour deadlines, the 10-day suspensive period when the enforcing State has been notified, and the Annex III forms.
